Personal Injury Case Results

Thousand Oaks personal injury lawyers at The Law Offices of Gerald L. Marcus have years of experience fighting for the rights of clients throughout Southern California. The firm takes on all types of personal injury cases, no matter how big or small they might seem. The truth is, all personal injury cases are important because they involve a victim injured by the negligent actions of another. Another component to most personal injury claims is the insurance company. At our firm, we are not afraid to bring action against insurance companies when they offer our clients low settlements or wrongfully deny their claims. Our firm has never been afraid to take cases to court. We go to whatever lengths are necessary in order to secure maximum financial compensation. We have the means and the trial experience necessary to get a successful case result for you.

Listed below are just a few of the case results we have obtained for our clients.

CASE RESULTS

Wrongful Death Lawsuit - $3.6 Million Jury Verdict

Our client was the son of a murdered woman, his mother, who was brutally killed by her own husband. The defendant had already been convicted for the death of his wife after striking her in the head 19 times with a hand ax and he was sentenced to a minimum of 42 years in prison. Nothing can bring back his mother, but the son wanted to seek emotional, physical and financial restitution for his severe loss.

We sought after justice and our attorneys took his wrongful death claim to court and after a two-day trial and only two hours of jury deliberation we proved that this killing was done with malicious intent and significant rage. The Son was awarded $3.6 million in damages and the deed to the couple's former home.

Rear End Auto Accident (Underinsured Biding Arbitration) Offer of $2,000.00 - Settled for $140,000.00

Our Client was a passenger in a car that got rear ended. He suffered back injuries. He received therapy and epidural injections. We settles the first part of our client's claim for the minimal policy limit of $15,000.00 against the insurer for the driver of the car our client was a passenger in for $85,000.00, which was the remainder maximum balance available under the policy coverage. The insurance company only offered $2,000.00 to settle our client's injury claim. We fought the insurance company and its attorneys for more than two full years. After extensive discovery, litigation, and expert deposition, we arbitrated the case and WON. The Judge awarded our client $140,000.00

Rear End Accident - Settled for $280,000.00

Our Client was rear ended in a car accident resulting in neck surgery. The defendant's insurer disputed the impact, property damage, causation, and nature and extent of injuries.

The only offer ever made was $30,000.00. We filed a lawsuit and aggressively litigated the case. Shortly before trial, we successfully negotiated settled for $280,000.00

Slip and Fall - Settled for $90,000.00

Our client slipped and fell in a restaurant, the bathroom, and injured his hip. There were no witnesses. There was no accident report to the restaurant. Our client suffered from a preexisting pediatric arthritic condition. After extensive litigation, discovery, depositions and mediation, we settle the case for $90,000.00

Near Pool Drowning - Settled for $600,000.00

This was a denied liability case involving our client who began to drown in defendant's resort-hotel swimming pool. The resort-hotel security guard witnessed our client in the first stage of drowning, but was inadequately trained and did not recognize it as drowning. The security guard mistakenly thought our client was "showing off" so he walked away. When he returned, the security guard observed our client in the final stages of drowning. Our client survived, but suffered permanent injuries.

This was an extraordinarily difficult and complex case involving legal issues concerning lifeguard requirements, safety issues, drowning prevention, hotel management, security, medical causation and damages.

After years of litigation, discovery, expert retention, depositions and a Motion for Summary Judgment, we settled the case for $600,000.00

Car Accident - Minor Impact Rear End Accident - Settled for $95,000.00

Mercury Insurance denied our client's claim arguing that the force of the impact was insufficient to cause any injury. Mercury offered our client only $200.00. Our client was represented by two different attorneys who were unsuccessful in convincing Mercury that, in fact, Karie's neck was injured in the accident. We took over the case and aggressively litigated against Mercury Insurance and its team of defense attorneys and experts. We successfully settled the case for $95,000.00 shortly before trial.
